When you sign up to judge a team practice, a student coach will send you all of the materials you need to get up to speed on the relevant law and arguments both sides will be making.  The student coach will also let you know of any relevant information, such as time or location changes.  If you have any questions about a specific practice time, please email the student coach.  Their contact information should be on the individual team’s webpage.  You can get to an individual team’s webpage by clicking their name.  When you arrive at a practice, please introduce yourself to the student coach and the competitors.  The team members are always excited to see new and old faces.

Maryam Samimi and Zahra Muzaffar

(1)  Whether collection of real-time cell-site location information (“CSLI”) for one cellphone “ping” lasting two-and-a-half hours constitutes a search under the Fourth Amendment.

 

(2)  Whether using a smartphone camera to see through a tinted window of someone’s home from a public vantage point constitutes a search under the Fourth Amendment.

Richard Young & Jonathan Luciano

Scarlet Broadcasting v. Plum Enterprises 

Bench memo available on Box. In an episode of its television show, Mustard, Plum Enterprises used Scarlet Broadcasting's mark to comedically comment on Scarlet's recent entanglement with money laundering. Scarlet Broadcasting then brought a claim for trademark infringement against Plum. In its cross complaint, Plum alleged that Scarlet infringed Plum's copyright in a publicity photo for Mustard when Scarlet embedded the photo on its website. However, Scarlet claims that Plum never owned the copyright in the photo because there was no work for hire relationship established between the photographer and Plum. The following three questions presented are now before the Supreme Court: 

  1. Whether and to what extent Defendant’s use of Plaintiff’s trademark in an expressive work is entitled to heightened First Amendment protection.

  2. Whether alleging a claim for work made-for-hire under 17 U.S.C. § 101 largely, but not independently based on the Reid control factor, is sufficient to survive a motion to dismiss under Rule 12(b)(6).

  3. Whether a server necessarily must contain a copy of an embedded or framed copyrighted work in order to violate the 17 U.S.C. § 106(5) display right.

Hayley Slater, David Gay

1. Whether § 1512(c)’s mental state of “corruptly” requires the prosecution prove that the defendant acted with the intent to obtain an unlawful benefit for himself or another, an interpretation consistent with the mens rea’s long standing meaning, or whether it merely requires the defendant act with an unlawful purpose or through unlawful means.

2. Did the D.C. Circuit err in failing to apply additional canons of interpretation when analyzing the ambiguity of “otherwise” within 18 U.S.C. 1512, resulting in a near limitless interpretation of the scope of prohibited conduct including acts unrelated to those exemplified in the statute?

I. Whether purchasers of shares of a class of stock issued in a direct listing have standing to bring a claim under section 12 of the Securities Act of 1933 even though they cannot trace their purchased shares to a prospectus.

II. Whether failure to make a disclosure under Item 303 of Securities and Exchange Commission Regulation S-K can give rise to a claim of securities fraud under Section 10(b) of the Securities Exchange Act of 1934 even in the absence of an otherwise misleading statement or an independent duty to disclose the allegedly omitted information.

II. Is 18 U.S.C. § 922(g)(3) unconstitutional as applied to Mr. Cooper when it prohibits him from possessing firearms based on his alleged use of marijuana, without requiring the government to establish time of last use or resulting intoxication?

I. Did the 13th Circuit err in holding that Officer Wiggum's traffic stop of Alexander Stevens was not unconstitutionally prolonged for the purposes of the Fourth Amendment? 

II. Did the 13th Circuit err in finding that Officer Wiggum's Automatic License Plate Reader (ALPR) query used on Stevens' tour bus was not an unconstitutional search under the Fourth Amendment?

Elisa Santos, Brian Weikel

This is an interlocutory appeal of the district court’s order granting a preliminary injunction. Plaintiff Barbara Films, Inc. (“Barbara”), whose founder Barbara Fields (“Ms. Fields”) is a pioneering filmmaker whose works include the computer-animated film A Dog’s World, alleges that Defendant Atomic, Inc. (“Atomic”), a leading technology and media company, committed copyright infringement, by creating—with extensive use of Artificial Intelligence (“AI”)—the screenplay and planned film, Pet’s World. In the district court case, Barbara also asserts a patent infringement cause of action, which was not addressed in the current appeal. Atomic timely noticed this appeal the day after the district court granted a preliminary injunction.

Two issues are on appeal to the United States Court of Appeals for the Federal Circuit1:

(1) Whether Plaintiff is entitled to preliminary injunctive relief based on its copyright infringement claim;  

(2) Whether Defendant’s use of Plaintiff’s copyrighted works, including the training of TalkABC with Plaintiff’s copyrighted works, was fair use.

1. Does 46 U.S.C. § 30509 extend to seagoing vessels engaged in a roundtrip voyage, thereby invalidating a vessel owner's waiver clause limiting liability for personal injury?

2. Do defendants retain their constitutional right to a jury trial when filing a counterclaim if the plaintiff has already designated the claim for admiralty court under Federal Rules of civil procedure 9(h)?

Adsser Abude, JK Connally, Adi Nair

Peace officers' professional organization brought action against the City of Portola, seeking an injunction requiring it to comply with a California statute requiring a complainant to sign an advisory informing them that filing a knowingly false complaint alleging misconduct by a peace officer may result in criminal prosecution. The Superior Court entered judgment in the organization's favor and ordered an injunction against the City. The City appeals.

The case is pending before the Seventh Appellate District of California and raises the following issues:

  1. Does the City have standing to appeal or to raise its constitutional arguments?
  2. Does Penal Code section 148.6, subdivision (a), particularly subdivision (a)(2), constitute improper viewpoint discrimination in violation of the First Amendment?
  3. Does Penal Code section 148.6, subdivision (a), particularly subdivision (a)(2), impose an impermissible burden on the ability to file, or on the City to accept, police misconduct complaints?
  4. Is it error to compel the City to comply with a statute that has been ruled unconstitutional by the United States Court of Appeals for the Ninth Circuit?
