When you sign up to judge a team practice, a student coach will send you all of the materials you need to get up to speed on the relevant law and arguments both sides will be making.  The student coach will also let you know of any relevant information, such as time or location changes.  If you have any questions about a specific practice time, please email the student coach.  Their contact information should be on the individual team’s webpage.  You can get to an individual team’s webpage by clicking their name.  When you arrive at a practice, please introduce yourself to the student coach and the competitors.  The team members are always excited to see new and old faces.

The case concerns a state statute banning abortion with limited exceptions. Questions presented are (1) Does a statute banning all pre-viability elective abortions after fifteen weeks violate a woman's constitutional right to abortion; and (2) does a state statute requiring healthcare facilities to dispose of fetal remains impose an undue burden?

Zoe Gallagher and Zhi Yang Tan

This case deals with a federal civil rights action under 42 U.S.C. § 1983 against Defendants, the Rocky Hills Unified School District and Principal George Galvan. Plaintiff Jennifer Rodriguez, valedictorian of Rocky Hills High School, alleges that Defendants’ censorial actions against her violated her First Amendment free-speech rights. The Defendants prohibited Plaintiff from delivering her speech at her high school graduation because of the speech’s religious content. Plaintiff contends this amounts to viewpoint discrimination in violation of the First Amendment.

Issues:

(1) Does a school district violate the free speech rights of a student and engage in impermissible viewpoint discrimination by requiring her to remove all religious references from a graduation speech?

(2) Does a school district violate the free exercise rights of a student by excluding religious references from a graduation speech based on fears of a possible Establishment Clause violation?

  1. The False Claims Act’s first-to-file rule only allows the first suit to give notice of a fraud scheme to move forward in the trial process.  Does this rule that bars the second fraud suit do so on the grounds of subject matter jurisdiction and should the Petitioner’s case, which was the second suit to allege fraud, be barred when the first suit failed to adequately state a claim?

 

  1. Within the False Claims Act, there is no specified definition of fraud, which has led the majority of circuit courts to presume its common law meaning.  Can the plaintiff be successful by proving that a subjective clinical opinion was false by misrepresentation by omission without being required to show objective falsity and did the Petitioner meet this standard?

An Le, Scott Smit

Mouse House is a prominent film production company and owns the rights to the film Alaadar. Alaadar, which was released in 2010, is a science fiction movie where the protagonist Jack Scully interacts with the native, Nanki, on a moon called Pantora while secretly working for a terrestrial military organization. The Nanki have feline features, blue skin, and are tall with technologically primitive humanoid looks. They fly through the air on Mountain Banshees and ride them for hunting. Mouse House plans on creating a theme park called "Discover Pantora" and registered that name as a trademark. In 2000, FarSky Studio and Interstellar Entertainment ("FarSky Studios" collectively) released the first Valkyrie videogame. FarSkye Studios announced the release of the newest Valkryie game, Valkryie: Mission Centauri which was set to be released in 2021. The video game is set in the year 3000 on Pantera and features an all-female special forces unit going to a distant world to protect the star system from an extremist group. The natives of Pantera, the Makai, ride sea creatures called Sea Basiliks and protect the Well of Life. Advertisements for Valkryie include the caption "Discover Pantera." In January 2020, Mouse House filed an action against Farskye Studios alleging copyright infringement and trademark infringement. 

 

Issues:

1. Whether FarSky Studio's and Interstellar Entertainment's new video game is substantially similar to the movie Alaadar to constitute copyright infringement?

2. Do FarSky Studio's and Interstellar Entertainment's use of the phrase "Welcome to the Moon of Pantora," infringe on Mouse House Inc. and Jamie Jameson's trademark for "Welcome to the Land of Pantora."

Taylor Boyle, Anushka Silva

Petitioner, Keegan mason, worked for SAM Clinics as a clinical nurse specialist. She worked alongside the physicians who certified submissions for HBO therapy for medicare services. During her time there, she saw changes in wound grade assignments to be higher, in a way that would qualify them for HBO therapy. She also overheard conversation which she took to mean that the clinic was falsely certifying HBO therapy treatment when it was unnecessary for the patients. At a similar time, there was a lawsuit between another SAM Clinics doctor, Dr. Cobb and SAM Clinics for an FCA violation. Petitioner obtained an affidavit from another doctor certifying that the claims for reimbursement were medically unnecessary and unreasonable. Petitioner brought a claim as a relator under qui tam seal saying that the claims were fraudulent. SAM Clinics filed a 12(b)(1) motion for lack of SMJ and 12(b)(6) for failure to state a claim. 

1) Does the FCA’s first-to-file rule establish a rule of subject matter jurisdiction and was

Petitioner’s case barred by that rule?

 

2) Can certification of a medical opinion be false under the FCA or must the relator show

the certification was objectively false, and did Petitioner in this case meet the requisite

standard?

Josie Chan and Rizelle Dizon

State of Apalsa's AAPI and Native American community members have formed a coalition to bring a claim under Section 2 of the Voting Rights Act, alleging unlawful racial gerrymandering because the Redistricting Plan fragments the AAPI and Native American populations, diluting their political power.

Issues Presented:

1. Whether two minority groups may be combined to satisfy the first threshold condition articulated in Thornburg v. Gingles, 478 U.S. 30 (1986), to state a claim under Section 2 of the Voting Rights Act of 1965; and

2. Whether Petitioner's challenge to the State of Apalsa's apportionment of congressional districts alleges partisan gerrymandering, and thus, presents a non-justiciable political question under Rucho v. Common Cause, 139 S. Ct. 2484 (2019).

Background:

Recently, in the State of Apalsa, its two major political parties, Traditionalist Party and Progressive Party, have each proposed redistricting plans, in response to the 2020 Census.  Traditionalist Party's Redistricting Plan, which was eventually adopted, will make the Traditionalist Party a majority in five of the six congressional districts.  In Apalsa, nearly 80% of registered voters who identify as White Non-Hispanic are registered Traditionalists and 75% of registered voters who identify with Apalsa's other racial and ethnic categories are registered Progressives.

Michelle Claros, Alysyn Martinez, and Hunter Morrissey

 

Hailey Hatterfield, was an employee at Kite Hill Elementary school. In response to a deadly virus known as COVID-20, Kite Hill school district created a safety protocol, which required all employees to schedule a blood test. Employees were mandated to share their blood test date with the district's superintendent. Additionally, employees were required to quarantine at home from the time their blood was drawn until the beginning of the school year. Failing to follow these protocols would result in termination.

Hailey violated this protocol by attending an event after her blood was drawn and the superintendent began the process of terminating Hailey. After the process began, a text message was sent to Hailey's phone, indicating her test results. Hailey received this text in public with a fellow Kite Hill employee, who later shared this information with the superintendent.

Hailey has alleged this text message was a violation of the Telephone Consumer Protection Act and that the text with her test results was an invasion of privacy.

Issues:

(1) Whether a consumer must suffer actual concrete damages for that consumer to have standing to sue under the Telephone Consumer Protection Act?

(2) Whether an unsolicited text message disclosing blood test results would be highly offensive to a reasonable person as defined by section652B of the Second Restatement of Torts?
